These terms are an agreement between you (the agency signing up, "you") and [Company legal name], company number [company number], registered office [registered office address] ("we", "us"), for the use of Tempbench, our online recruitment CRM.

1. Your account

You must be at least 18 and signing up on behalf of a business. You are responsible for everyone you invite, for keeping passwords private and for what happens under your account. Tell us straight away if you think your account has been accessed without permission.

2. Free trial

New agencies get a 30-day free trial with every feature and no card needed. When the trial ends your account becomes read only until you choose a plan. We keep your data for at least 60 days after a trial ends so you can pick up where you left off, unless you delete it sooner.

3. Plans, seats and payment

Paid plans are charged per seat. A seat is one active user. The price is shown on the Plan and billing page before you pay (currently £12.99 per seat per month, or £129.90 per seat per year, plus VAT where it applies).

Payments are taken by Stripe at the start of each billing period. When you add or remove users, the number of seats changes and the next invoice is adjusted for the part period. Prices exclude VAT, which is added where it applies. If a payment fails your account becomes read only until it is paid.

4. Cancelling

You can cancel at any time from the billing page. Your plan runs to the end of the period you have paid for and is not refunded for unused time, except where the law requires. After that your account becomes read only, and you can export your data or delete it.

5. Your data

Everything you put into Tempbench is yours. You are the controller of the personal data you store about candidates, contacts and your team, and we process it on your behalf under our data processing agreement, which forms part of these terms. You must have a lawful basis for the data you store and must tell candidates how you use their data.

You can export all of your data at any time from Settings. If you delete your agency, we delete your data from the live system straight away and from backups within [35] days.

6. Acceptable use

• Do not upload anything unlawful, or data you have no right to hold.
• Do not try to access another agency's data, test our security without written permission, or overload the service.
• Do not resell or copy the service.

We may suspend accounts that break these rules, and will tell you why unless the law stops us.

7. Availability and changes

We work hard to keep Tempbench running and secure, but we do not promise it will never be interrupted. We may improve or change features; if we remove something important we will give you reasonable notice.

8. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot legally be limited. Otherwise, we are not liable for indirect or consequential loss, loss of profit or loss of business, and our total liability in any 12 months is limited to the fees you paid us in that period.

9. Ending the agreement

Either of us may end this agreement by cancelling. We may end it immediately if you seriously break these terms. Sections 5 and 8 continue after it ends.

10. General

We may update these terms and will give at least 30 days' notice of material changes by email. These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. Questions: hello@tempbench.co.uk.
